Terms of
service
These terms cover your use of this website and the enquiries you send through it. Actual productions are governed by a signed production agreement — which always takes precedence over anything written here.
Effective date: November 4, 2026
01The agreement
These Terms of Service (“Terms”) govern your access to and use of production34.com (the “Site”) operated by Production 34 LLC, Brooklyn, New York (“we”, “us”). By using the Site you agree to these Terms. If you don't agree, please don't use the Site — though you're always welcome to email us instead.
02Using this site
- The Site is provided for information about our studio and for submitting project enquiries.
- You may not scrape, mirror or resell the Site's content, or use it to train machine-learning datasets.
- All text, images, logos, case-study content and design on the Site belong to Production 34 LLC or its licensors. Viewing is fine; republishing needs written permission.
- We may update or withdraw any part of the Site at any time without notice.
03Enquiries, quotes & estimates
Submitting the brief form or emailing us starts a conversation, not a contract. Nothing is binding on either side until a production agreement is signed by both parties.
- Prices shown on the Services page are starting points, not fixed quotes. Every project is scoped individually.
- Written quotes are valid for 30 days unless stated otherwise.
- Dates mentioned in conversation are provisional until they appear in a signed agreement or booking confirmation.
04Fees & payment
- Standard terms for new clients: 50% deposit on booking, balance on delivery, unless the signed agreement says otherwise.
- Invoices are payable within 14 days. Late payment may pause work and accrue interest at 1.5% per month where permitted by law.
- Pre-approved client costs (travel, permits, talent, catering, media) are billed at cost. Receipts available on request.
- Rates quoted cover the agreed scope; changes to scope after signature are quoted separately as change orders before any work begins.
05Cancellations & rescheduling
- More than 14 days before the first shoot day: deposit refunded minus costs already committed (crew bookings, permits, equipment hold fees).
- Within 14 days of the first shoot day: the deposit covers committed costs and reserved crew time; the remainder is refunded or credited.
- One reschedule inside 30 days of a shoot is free if the replacement date is within 90 days and crew is available.
- Weather calls for exterior shoots are made jointly at least 12 hours before call time where possible — we don't charge for acts of sky.
06Rights in the footage
Unless the signed agreement states otherwise:
- Upon full payment, the client receives the licensed usage rights described in the agreement for the delivered films.
- Production 34 retains copyright in all raw footage, out-takes and behind-the-scenes material, and the right to show the delivered work in our portfolio and reel — unless the agreement includes an NDA or embargo, which we honour absolutely.
- Unused footage can be licensed or purchased separately at any time; just ask.
- Music, stock and archival elements are licensed for the agreed usage and term; extending usage later is possible and quoted at cost.
07Confidentiality
Everything you send in a brief is treated as confidential: unreleased products, internal plans, talent details, budget figures. We don't discuss one client's project with another, and NDAs are welcome before anything sensitive is shared. Our crew and vendors operate under the same obligations through their project paperwork.
08Third parties, locations & permits
- Filming permits, location fees and insurance certificates are arranged and billed per the signed agreement.
- Clients are responsible for obtaining necessary releases from people appearing in their films (we'll flag what's needed during pre-production and can handle paperwork for a fee).
- Links to third-party sites (Vimeo, etc.) are provided for convenience; we're not responsible for their content or policies.
09Disclaimers & liability
The Site is provided “as is” without warranties of any kind. Case studies and prices on the Site are illustrative; your rights come from your signed agreement, not from this Site.
To the maximum extent permitted by law, our total liability arising from use of the Site or any enquiry submitted through it is limited to $100. Liability for production work is governed exclusively by the signed production agreement, which typically caps liability at the fees paid for the affected project. We are not liable for indirect or consequential losses.
10General
- These Terms are governed by the laws of the State of New York; disputes will be heard in the state or federal courts of New York County.
- If any provision is found unenforceable, the rest stays in force.
- We may update these Terms; the effective date above always reflects the current version.
